No they can only give you a new samsung smooth and thats only if you have the insurance/warranty plan on it. You would have to pay an early termination fee in order to get a new Palm Pre and that can be more than $100 depending on the phone and time until your contract ends.

Typically, if you phone gets damaged, and you have their accidental-damage insurance coverage, you can only replace your phone with the same make and model.

That depend if you have warranty, but even with warranty, you have to get the same phone
