its been almost a month since we told the landlord that the bathroom above us leaks into our bathroom and the ceiling tile has brown water damage and now has mold on it. (we have drop down ceilings) i also have a newborn and mold is not good to breathe in! can i make him fix it? what are my rights? hes very stingy and last month we had a mixup at the bank (completely the banks fault) and he had the downstairs neighbor give us a letter saying if we didnt pay him in 3 days we were going to county court and getting evicted. he is a complete jerk and think he should fix it asap. anyone had a smiliar experience?

I would continue to call and leave messages/voice mails etc. and keep track of all correspondence with your landlord. If this doesn't work I would call city hall and talk to the building inspector's office and explain what your situation is. In Massachusetts they are very responsive (usually same day) especially if someone from an "at risk" population (elderly, children) lives in the affected area. If the inspector finds a violation in your apartment than your landlord will be mandated to fix the issue. Good luck!

Dont worry too much about evictions if your paid up. Either way, the sheriffs ( who is the ONLY person who can evict you ) are so tied up with housing foreclosures, they might not get around to you for months
I'd be looking for somewhere else to move, just in principle.
Call the county health dept and see what they say or who they can reference you to. That is unhealthy for your baby

Call you town or city health inspector. Have him/her come to your apartment and evaluate the situation. They will be happy to contact your landlord to resolve the situation, if they see a problem.
The crack is the landlord's fault. Take a good picture, and make sure you weren't the cause for that crack. If you prove that, your safe.
he has to fix it. no matter what! hes the "Landlord" for a reason, get onto him about it and if he still doesnt do anything tell him you are going to turn him i for making you live like that. you really can do that!
bathroom leaks are very easy to repair, it is usually just a chipped gasket or bad seal.Tell him to fix it or else you will take him to court.
tennent forgets to pay rent get the picture! and take pictures of this stuff and date them so u can have evidence against his slack a$$
