Is there a way that his son (26) can claim these as part of the estate? His disability was mental illness and he would not communicate with anyone. He also stopped receiving his SSA benefits 10 + years ago because he couldn't process the paperwork and would not answer his door. VA just flat out says send the checks back, they are no good. There is over $200 thousand dollars in VA checks in his apartment

the Son needs to contact the VA with proof of the death (death certificate), the uncashed checks, the will showing the estate being left to the son, and proof that the son is indeed the offspring of the deceased

If the payments were due the deceased person, I would think the VA should replace them. US Treasury checks are void after 1 year from the issue date.
I would ask a lawyer about that.
