I am a leader in a National Guard Unit, I have a soldier that claims to be starting some military like organization, he is an e-1 and wears DCU's with Colonel ranks and his "*** Army" nametape ( i don't know the name) where U.S. Army Goes. he also has a buddy that wears captain bars
What legal right do i have to Forbid him from wearing such, but more importantly what regs and references can i use in counseling

As far as the Guard and Reserve go, there is nothing against playing soldier in your off time. However, you cannot be trying to "impersonate" a soldier with his militia uniform. Wearing DCU's with no official military patches or insignia is technically not in violation of AR 670-1. However, if he does this while on duty and/or on drill weekends then you can hold him accountable.
Go on your AKO account, and go to the pubs and forms section. There are a few regs there on proper wear of the uniform, besides AR670-1 there is another on legal wear of the uniform.
Another source is your JAG office, call them and ask for some direction in the matter.
It may just be that he's an immature kid who is forming his own "boy's club" where he can be the big man.
There is also the matter of conduct unbecoming, if he is doing anything that may reflect in a negative way on the Army and National Guard.
Impersonating a Military Officer is a Federal Crime...

a private wearing colonels insignia? how about starting with out of uniform. you guys even have a chain of command? use it.
